Notecard.co.uk ("Website") is a revision website for students provided by Notecard, a subsidiary of Mandt Education Ltd. ("Company"). By accessing and using the Website, you agree to be bound by the following terms and conditions ("Terms of Use").
1. General Terms
1.1 The Website is intended for use by individuals who are preparing for academic examinations.
1.2 The Website contains various resources including, but not limited to, an AI flashcard generator ("Service"). The Service allows users to generate flashcards for study purposes by uploading their own notes, slides, or other study materials ("User Content").
1.3 The Company makes no representations or warranties of any kind, express or implied, as to the accuracy, completeness, or usefulness of any of the User Content or the generated flashcards. The Company also makes no representations or warranties that the Service will be error-free, uninterrupted, or free from unauthorised access.
1.4 The Company reserves the right to modify or discontinue, temporarily or permanently, the Website or the Service, or any portion thereof, with or without notice.
2. Account and Data Responsibility
2.1 As a registered user, you are responsible for all activities that occur under your account and for maintaining the security and confidentiality of your password.
2.2 The Company does not store User Content. User Content is held in memory during the generation of flashcards and is cleared afterwards.
2.3 The Company does not store generated flashcards. Users are responsible for the storage and usage of the generated flashcards once they have been created.
3. Credit Packs and Refund Policy
3.1 The Service operates on a credit-based system. Users can purchase "credit packs" which provide a number of credits that can be spent on using the Service. Larger inputs require more credits to be spent in order for the Service to operate.
3.2 Unless the system is unable to generate flashcards due to a system error, in which case the user is automatically refunded, credits spent on the Service are non-refundable, even if no flashcards are created by the AI (e.g., due to a poor input not containing any useful data).
3.3 Except where required by law, credit packs purchased through Notecard are non-refundable.
3.4 The Company reserves the right to withhold the 25 credit signup bonus for users with temporary, invalid or untrustworhy email addresses. The Company also reserves the right to cancel the offer at any time.
3.5 Credits earned through the signup bonus program are subject to the same terms and conditions as credits purchased directly through the Service.
4. Referral Program
4.1 The Company offers a referral program that allows users to earn credits by referring friends to the Service. For each successful referral, defined as a new user signing up for the Service using the referrer's unique referral link, the referrer will receive 25 credits.
4.2 In addition, the referrer will receive the same amount of credits as any credits their referred friends purchase. The Company will match the purchased credits and award them to the referrer's account.
4.3 The Company reserves the right to modify, suspend, or terminate the referral program at any time without prior notice. The Company may also disallow specific users from participating in the referral program if abuse or fraudulent activity is suspected.
4.4 The Company does not accept referrals from users with temporary, invalid or untrustworthy email addresses. The Company reserves the right to determine the validity of an email address for the purpose of the referral program.
4.5 Credits earned through the referral program are subject to the same terms and conditions as credits purchased directly through the Service.
5. Prohibited Content and Activities
5.1 Users are responsible for ensuring that their User Content does not infringe on any copyrights or other intellectual property rights. The Company is not responsible for the content of User Content.
5.2 Prohibited content includes, but is not limited to, content that is harmful, offensive, indecent, unlawful, infringing, or otherwise objectionable. Any engagement in such activities may result in termination of your account.
6. Content and License
6.1 The generated flashcards are intended for personal, non-commercial use only. You may not distribute, modify, transmit, or use the flashcards for commercial purposes without the prior written consent of the Company.
6.2 The Company continually strives to improve and expand the features of the Service. However, you acknowledge and agree that any new features, enhancements, or modifications to the Service are not guaranteed and are subject to change at the sole discretion of the Company.
7. Responsibility of Service Users
7.1 You are responsible for your use of the Service and for any User Content you provide, including compliance with applicable laws, rules, and regulations.
7.2 You represent and warrant that you have all the rights, power, and authority necessary to grant the rights granted herein to any User Content submitted.
8. Third-Party Content and Websites
The Website may contain links to third-party websites or resources. You acknowledge and agree that we are not responsible or liable for the availability, accuracy, content, or services of such third-party websites or resources.
9. Changes to the Service and Terms
We reserve the right, at our discretion, to modify or replace any part of these Terms of Use at any time by posting a notice on our website or by sending you an email.
10. Governing Law
These Terms and your access to and use of the Notecard platform will be governed by the laws of the United Kingdom.
